These terms govern your use of Gloombook — a creative sanctuary for audio, video, and writing. Please read them carefully before using our platform.

Who Can Use Gloombook

You must be at least 13 years old. If you're under 18, a parent or guardian must review and agree to these terms on your behalf.

Your Content, Your Rights

You retain full ownership of everything you create and upload. We only use a limited license to display and distribute your work on our platform.

Community Standards

Gloombook is a sanctuary for creativity. Harassment, hate speech, spam, or illegal content will result in immediate account termination.

Acceptance of Terms

By accessing or using Gloombook — whether through our website, mobile application, or any associated services — you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, you must not access or use Gloombook. Your continued use of the platform after any update to these Terms constitutes your acceptance of the revised version.

These Terms apply to all visitors, registered users, and anyone who accesses or uses our services in any capacity.

Eligibility & Account Registration

To use Gloombook, you must meet the following requirements:

  • You must be at least 13 years of age. Users between 13 and 17 must have parental or guardian consent.
  • You must provide accurate, current, and complete information during registration and keep your account details up to date.
  • You must not have been previously banned or removed from Gloombook for violating our Terms.
  • You must be legally permitted to enter into a binding agreement. Under the Indian Contract Act, 1872, you confirm that you are of sound mind and not disqualified from contracting by any law to which you are subject.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@gloombook.com if you suspect any unauthorised access to your account.

Gloombook reserves the right to refuse registration or cancel accounts at its sole discretion.

Your Content & Intellectual Property

You retain full ownership and all intellectual property rights to the content you create, upload, or share on Gloombook — including music, audio recordings, written works, and videos.

By uploading content, you grant Gloombook a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the platform.

This license ends when you delete your content or your account, except where your content has been shared by others, in which case the license continues until all such copies have been removed.

You confirm that you own or have the necessary rights, licences, and permissions to upload and share all content you post on Gloombook.

Gloombook's Intellectual Property

All aspects of the Gloombook platform — including but not limited to the website design, logo, interface, software, code, graphics, and written content created by Gloombook — are the exclusive property of Gloombook and are protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of our platform without prior written permission from Gloombook.

The Gloombook name, logo, and associated marks are trademarks of Gloombook. Unauthorised use of these marks is strictly prohibited.

Prohibited Conduct & Content

Gloombook is built as a sanctuary for genuine creative expression. To protect the integrity of this space, the following conduct is strictly prohibited:

  • Uploading, sharing, or distributing content that is unlawful, defamatory, obscene, pornographic, or promotes violence or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Harassing, threatening, intimidating, or bullying other users or members of the Gloombook community.
  • Infringing the intellectual property, privacy, or other rights of third parties, including uploading content you do not own or have rights to.
  • Impersonating any person or entity, or misrepresenting your affiliation with any person or organisation.
  • Uploading or distributing malware, viruses, or any code designed to harm, disrupt, or gain unauthorised access to systems.
  • Scraping, crawling, or using automated tools to extract data from Gloombook without our express written consent.
  • Attempting to circumvent any security, access control, or content moderation features of the platform.
  • Using Gloombook for any commercial advertising, spam, or unsolicited promotional material.
  • Engaging in any conduct that disrupts the experience of other users or interferes with the normal operation of the platform.
Important: Violations of these standards may result in immediate suspension or permanent termination of your account, removal of your content, and where appropriate, referral to relevant Indian law enforcement authorities. Certain violations may also constitute offences under the Information Technology Act, 2000 (including Sections 66, 67, and 79), the Indian Penal Code, 1860, or other applicable Indian laws.

Platform Availability & Service

Gloombook is currently in a pre-launch phase and is being meticulously designed to reach a global scale. We strive to maintain consistent access to our services, but we do not guarantee that the platform will be available at all times, uninterrupted, or free of errors.

We reserve the right to modify, suspend, or discontinue any part of the platform — temporarily or permanently — without prior notice. Gloombook will not be liable to you or any third party for any such modification, suspension, or discontinuation.

We may carry out scheduled or emergency maintenance that may result in temporary unavailability. Where possible, we will provide advance notice.

Disclaimer of Warranties

Gloombook is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Gloombook disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose.
  • That the platform will be error-free, secure, or continuously available.
  • That any content on the platform is accurate, complete, or up to date.

Your use of Gloombook is entirely at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Gloombook and its founders, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including but not limited to:

  • Loss of data, content, revenue, or profits.
  • Unauthorised access to or alteration of your content or account.
  • Any conduct or content of third parties on the platform.
  • Any interruption or cessation of access to the platform.

In no event shall Gloombook's total cumulative liability to you for any claims arising from these Terms or your use of the platform exceed the greater of (a) the amount you paid to Gloombook in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).

To the extent permitted under the Information Technology Act, 2000 and the Consumer Protection Act, 2019 (India), certain implied warranties and liabilities cannot be excluded. In such cases, Gloombook's liability shall be limited to the maximum extent permitted under applicable Indian law.

Privacy & Data

Your privacy is fundamental to who we are. Gloombook does not sell, rent, or share your personal data with advertisers or third parties for marketing purposes.

The data we collect — such as your name and email address during sign-up — is used solely to operate the platform, communicate important updates, and improve your experience. Our data practices are guided by the Information Technology Act, 2000, the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDPA).

By using Gloombook, you consent to the collection and use of your information as described in our Privacy Policy, which is incorporated into these Terms by reference.

You have the right to request deletion of your account and personal data at any time by contacting us at support@gloombook.com.

International Users & Global Privacy Laws

Gloombook is operated from India and your data is processed and stored in India under Indian law. If you are accessing our platform from outside India, please note the following rights and obligations based on your region:

🇪🇺 European Union & EEA (GDPR)

If you are in the EU or EEA, your data is protected under the General Data Protection Regulation (GDPR) (EU) 2016/679. We acknowledge the following rights for EU/EEA users:

  • Right of Access (Art. 15): Request a copy of the personal data we hold about you.
  • Right to Rectification (Art. 16): Request correction of inaccurate or incomplete data.
  • Right to Erasure / Right to be Forgotten (Art. 17): Request deletion of your data where there is no compelling reason for continued processing.
  • Right to Data Portability (Art. 20): Receive your data in a structured, machine-readable format.
  • Right to Object (Art. 21): Object to processing of your data in certain circumstances.
  • Right to Restrict Processing (Art. 18): Request limitation on how we use your data under certain conditions.

By using Gloombook from the EU/EEA, you consent to the transfer of your data to India. To exercise any GDPR right, contact support@gloombook.com. You may also lodge a complaint with your local Data Protection Authority (DPA).

🇬🇧 United Kingdom (UK GDPR)

Following Brexit, the UK applies the UK GDPR and the Data Protection Act 2018, which closely mirror the EU GDPR. UK users hold the same rights listed above. You may also contact the Information Commissioner's Office (ICO) at ico.org.uk with any concerns about our data handling.

🇺🇸 United States

US users should be aware of the following applicable laws:

  • COPPA (1998): We do not knowingly collect data from children under 13. Any such data discovered will be deleted immediately.
  • CCPA / CPRA (California): California residents have the right to know what data we collect, the right to delete it, the right to opt out of its sale (we do not sell your data), and the right to non-discrimination for exercising these rights.
  • Virginia CDPA, Colorado CPA, Connecticut CTDPA: Residents of these states have similar rights including access, correction, deletion, and portability of personal data.
  • CAN-SPAM Act: All marketing emails from Gloombook will include a clear opt-out mechanism. We will honour all unsubscribe requests within 10 business days.

🇦🇺 Australia

Australian users are protected under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). You have the right to access and correct your personal information. Data transfers to India are permitted under APP 8, provided we take reasonable steps to ensure compliance with the APPs. You may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au with any concerns.

🇨🇦 Canada

Canadian users are protected under PIPEDA (Personal Information Protection and Electronic Documents Act) and applicable provincial laws such as Quebec's Law 25 (Bill 64). You have the right to access your personal information, challenge its accuracy, and withdraw consent for non-essential processing. You may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca with any concerns.

🇧🇷 Brazil

Brazilian users are protected under the Lei Geral de Proteção de Dados (LGPD) — Law No. 13,709/2018. You have the right to access, correct, delete, and port your personal data, as well as the right to revoke consent. You may contact the Autoridade Nacional de Proteção de Dados (ANPD) with any complaints.

🇪🇦 United Arab Emirates

UAE users are subject to the Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). You have the right to access, correct, and request deletion of your personal data. Cross-border data transfers from the UAE to India are subject to adequate safeguards as required under the PDPL.

🇮🇰 Rest of the World

Regardless of your location, by using Gloombook, you:

  • Acknowledge that your data will be transferred to and processed in India under Indian law.
  • Are responsible for ensuring your use of Gloombook complies with the laws applicable in your own jurisdiction.
  • Consent to the collection and use of your data as described in these Terms and our Privacy Policy.
  • Understand that Gloombook does not sell, rent, or share your personal data with third parties for marketing purposes, regardless of jurisdiction.
  • Retain the right to contact us at any time to request access to, correction of, or deletion of your personal data.
Important Notice: Gloombook is a growing platform operated from India. While we have made good-faith efforts to acknowledge applicable international privacy laws, these Terms do not constitute full legal compliance in every jurisdiction. If you have specific legal concerns about how your data is processed, please contact us at support@gloombook.com before using the platform. We are committed to working with you to address any concerns.

Account Termination

You may delete your Gloombook account at any time. Upon deletion, your profile and uploaded content will be removed from public view, subject to our data retention obligations.

Gloombook reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we determine at our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the safety of our community.

Upon termination, your license to use the platform immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall continue to apply.

Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. By using Gloombook, you agree to submit to the exclusive jurisdiction of the competent courts in India.

In particular, these Terms are subject to the following Indian legislation:

  • Information Technology Act, 2000 (and its amendments) — governs electronic commerce, cybercrime, and online intermediary liability.
  • IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 — sets due diligence obligations for platforms like Gloombook.
  • Digital Personal Data Protection Act, 2023 (DPDPA) — governs how we collect, store, and process your personal data.
  • Consumer Protection Act, 2019 — provides rights and remedies for consumers using digital services in India.
  • Indian Copyright Act, 1957 — governs intellectual property rights over user-generated and platform content.
  • Indian Contract Act, 1872 — governs the formation and enforceability of these Terms as a legally binding agreement.

Dispute Resolution: In the event of any dispute or claim arising out of or relating to these Terms or your use of Gloombook, the parties shall first attempt to resolve the matter through good-faith negotiation within 30 days of written notice submitted to support@gloombook.com.

If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat and venue of arbitration shall be India. The proceedings shall be conducted in the English language by a sole arbitrator mutually agreed upon by the parties.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class action or representative proceeding.

Nothing in this section prevents either party from approaching a court of competent jurisdiction in India for urgent injunctive or interim relief to prevent irreparable harm.

Changes to These Terms

Gloombook is an evolving platform and we may update these Terms from time to time to reflect changes in our services, legal requirements, or community standards. We will notify registered users of any material changes via email or a prominent notice on the platform.

The date at the top of this page ("Last Updated") will always reflect when the most recent revision was made. We encourage you to review these Terms periodically.

Your continued use of Gloombook after any such changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the platform.
